AND FURTHER TAKE NOTICE that the 1st Respondent will apply to the

Court of Appeal for an order that the Appellant pay to the 1st Respondent the costs of and

occasioned by this Appeal.

TAKE NOTICE that the 1st Respondent herein seeks the

following further reliefs:

That leave to appeal be given in respect of the learned trial Judge's decision

to refuse to award to the 1st Respondent his costs of all the proceedings

before the learned Magistrate.

That the learned Trial Judge's order for costs in favour of the 1st

Respondent be amended to include the costs of all the proceedings before

ine learned Magistrate, the grounds whereof are:

that costs should follow the event.

that the costs recoverable should on principle include those incurred

before the tribunal whose decision has been quashed.
