1. Mr Burns has asked who would replace John Swaine on ExCo

when he resigns at the end of August, and whether there is a

statutory number of ExCo members. The size of the ExCo

membership is not fixed by statute, although there are four

ex-officio members named in the Royal Instructions: the

Chief Secretary, the Financial Secretary, the Attorney

General and the Commander British Forces. Otherwise,

subject to the approval of the Secretary of State, it is for

the Governor to decide whom, and how many, he appoints to

ExCo. He may choose to replace Mr Swaine with a formal or provisional appointment, but is not obliged to do so.

2.

The Governor announced on 12 June his intention to

appoint Mr Swaine as the first Deputy President of LegCo.

This appointment requires a formal instruction from the

Secretary of State before it can come into effect, and that will not be possible until after the September elections.
