I am very sorry not to have replied earlier to your letter of 9 February, asking for comments on a telegram from Hong Kong on this subject, which was passed to me by Peter Wrench, as policy on port medical examinations is one of my responsibilities.
Hong Kong ask you to clarify the current practice at ports of entry regarding the medical examination of the spouse or child of someone settled in the UK who is in possession of a medical certificate. Perhaps I could deal first with the question of examinations, and then turn to the issue of medical certificates.
The Concerned British Expatriates' Society are concerned that the spouse and child of someone settled here should be required to have a medical examination on arrival in the UK at all. Paragraph 80 of the Immigration Rules (HC 251) says that a passenger who intends to remain in the United Kingdom for more than 6 months should normally be referred to the Medical Inspector for examination. This obviously includes people who are coming to the UK for settlement. In practice, immigration officers use their discretion in deciding whether or not to refer an arriving passenger for medical examination, and do not necessarily so refer all passengers coming for more than 6 months who are apparently in good health. Thus referral for examination is not regular in the sense of invariable, but nor would we describe it as random.
Within this general approach, there is no particular practice with regard to the spouse or dependent child of someone settled in the UK, but I would expect that anyone coming for settlement
