Mr Au Yeung had not lived in the UK since 1980 and had paid only short infrequent visits since then. On his landing card he stated that the purpose of his journey was

to visit his sister, not entry as a returning resident. he received a visitors stamp in his passport.

So

Au Yeung was

given leave to remain for 6 months. He could have made application in the UK to restore indefinite leave to remain

at any time in the 6 month period. But he chose to return to Hong Kong after 8 days. He cannot now appeal because his leave to remain lapsed when he left the UK.
