Your note of Mr Lloyd's meeting on 3 October with Mr Ronald

Arculli, who is a member of LEGCO (the legislative council in Hong Kong), recorded Mr Arculli's continuing concern about the recent change in the Immigration Rules relating to returning residents and in particular the case of Mr Au Yeung. Mr Lloyd undertook to write to Mr Arculli

Representations on Mr Au Yeung's behalf have previously been made both by the Governor and OMELCO, who also raised the case as well as the general issue of returning residents when they met with Lord Caithness on 18 September As FCO thought that OMELCO had been satisfied by that meeting it is disappointing that an OMELCO member has returned to the charge.

3. It is clear that when Mr Au Yeung arrived at Heathrow in June he said that he was here for a 2 week visit, although he mentioned that he had previously been resident. There is no sign that he was asked more than the routine questions put to all passengers. We are satisfied that he was therefore properly admitted as a visitor; he had no intention of resuming residence in this country, and could not qualify for admission as а returning resident. In the event he returned to Hong Kong after a visit of 8 days. If before then he had applied for variation of his entry conditions to indefinite leave, that application would automatically have lapsed on his departure from this

country.
