Thank you for sending me a copy of a letter from Lydia Dunn
expressing concern on behalf of members of OMELCO about the
recent amendement to Rule 58 of the Immigration Rules. I have discussed this with Peter Lloyd at the Home Office.
As Lydia rightly points out, the Home Secretary has already
given assurances to Parliament about the purpose of the
amendment. It is intended to clarify the existing
provision, not to impose new conditions. It should have no effect on the position of people ordinarily resident here who wish to resume their residence after a temporary
absence; nor should it normally affect people ordinarily
resident here returning on holiday during a relative short
absence abroad. In such circumstances, an Immigration
officer would normally grant indefinite leave to enter or
remain in the UK. Moreover, as Lydia has also pointed out,
a specific instruction will be issued to Immigration
