If there is doubt about a person's eligibility to apply, the Post should write to Nationaltiy and Treaty Department before the above procedure is followed. If the doubt is resolved in the person's favour, that procedure should be followed and reference made to the correspondence with Nationality and Treaty Department.

Provision is made on the application form for the inclusion of any minor children of the applicant whom he wishes to have registered as British citizens. Unless they qualify to be registered under any other section of the Act, such children would be considered under Section 3(1) which, if granted, would confer citizenship by descent. The applicant should be made aware of this and advised of other avenues which his children may have at a later date and which he may wish to consider.

Subsequent Action

If registration is granted, the Home Office will issue a certificate of registration and will send it to Post for onward transmission to the successful applicant. If the applicant has to take the oath of allegiance, this must be done and the oath form returned to the Home Office before the registration certificate can be sent to Post.

If the application is unsuccessful, the Home Office will forward a letter of refusal to Post. This should be sent to the applicant together with a refund of the registration fee. There is no refund of the Consular fees charged for receiving the declaration or forwarding the application.
