REVIEW OF MERCHANT NAVY SENIOR OFFICER NATIONALITY REQUIREMENTS

1. This minute is intended to supplement Miss Hancock's minute of 24 July.

2.

The following persons with a Hong Kong connection will continue to have a British nationality status after 1997:-

(a) those who are British citizens under the British

Nationality Act 1981 or registered as such under the British Nationality (Hong Kong) Bill 1990;

(b) those BDTCs who, before 1 July 1997, apply to be

registered as a British National (Overseas);

(c)

those BDTCs who would otherwise be stateless when, in accordance with the Hong Kong (British Nationality) Order 1986, they lose their status as BDTCS, who will become British Overseas Citizens. This category will be composed of people who are not ethnic Chinese since those who are ethnic Chinese will in accordance with the Nationality Law of China be Chinese citizens.

Persons in categories (a) and (b) above may also have the status of Chinese citizens under the Nationality Law of the PRC, ie they may in fact have a dual nationality status, though the Chinese will not recognise a second nationality in respect of a person who is a Chinese citizen under Chinese law. British law is indifferent to British subjects also enjoying the nationality of another State.
