I am writing to you in your capacity as a member of the commit discuss the British Nationality (Hong Kong) Bill.

ANNEX B

I represent a group of British citizens living in Hong Kong whose spouses do not hold full British passports. Typically we hold senior positions in our various fields and cumulatively represent considerable experience in Hong Kong. We want to stay here and continue to contribute over the difficult years ahead.

Existing immigration law and practice is forcing British citizens in our position to leave Hong Kong. Neither the package as currently drafted nor recent announcements by the Home Secretary concerning possible provisions to be made give us the confidence to stay. In our view the solution to this problem is simple, uncontentious and most likely to be acceptable to public opinion.

Whilst the Government has indicated some appreciation of our situation the measures taken are not sufficient to encourage us to stay. In fact, the inadequacy of the provisions offered by the Home Secretary will in most cases reinforce our concerns and hence may lead to an even greater departure from Hong Kong of British citizens.

I take the liberty of enclosing a paper which sets out in some detail our circumstances and our concerns. The Home Secretary's recent statements sought, no doubt in good faith, to give us confidence. Unfortunately they have made us realise that unless something can be done we will need to reconsider our future in Hong Kong as a matter of urgency.

What we seek is an amendment to the British Nationality (Hong Kong) Bill to address our circumstances and we ask for your serious consideration of our case.
