As promised in my letter of 15 March, I am now on the following subjects raised in your
reverting to you
letter of 13 March
a)
constitutional
status of HKID personnel in
relation to the Governor;
b)
loss of right of abode in Hong Kong; and
c) origin and rationale behind occupational
groupings.
Constitutional status of HKID personnel
2.
In carrying out the existing provisions of BNA 1981, HKID personnel have been authorised by the Governor to exercise his powers as his agents, not as his delegatees.
This is in accordance with our Crown Solicitor's advice given in 1983. Subject to HMG's agreement, it is envisaged that similar arrangements will be made for HKID personnel to assist the Governor in the exercise of his powers under the Bill. However the Bill must make it clear that the Governor is not obliged to consider every application personally.
