The Secretary of State has seen your submission
9 March and Mr Walters' letter of 9 March to Stephen Wall, which I enclose herewith. He spoke to the Home Secretary on the telephone on 11 March and put three points to him:
a.
He asked the Home Secretary to cut out paragraphs 16 and 17 of his draft OD (K) paper on the grounds that there was no point in describing in detail what the scheme was to have been like before Ministers decided to change it. The Home Secretary agreed to look at this and was inclined to agree.
b.
The Secretary of State suggested that the phrase in your draft points to make "other key personnel who perform essential functions and whose continued presence in Hong Kong is demonstrably in the public interest" should be used to make it clear that the categories would be administered so as to include all key personnel as there defined, but without creating an extra category. The Secretary of State cited air traffic controllers and interpreters. The Home Secretary agreed to consider this suggestion favourably.
The
C. On the Approved Secondment Scheme, the Secretary of State suggested that the Home Ofice should concoct an entry certificate scheme outside the Bill but within the 50,000 ceiling in order to try to meet British companies wishes. Home Secretary agreed to this in principle. I have discussed with Mr McLaren on the telephone whether this in fact needs to be spelt out in the draft OD (K) paper and we agreed that a brief reference to the need for further work on the scheme outside the Bill might be all that is required.
