HMG will advise on the definition of "British

firms" bearing in mind that the definition should be

clear and precise enough to enable Immigration

Department staff to apply the definition easily.

Status of Spouses of Principal Beneficiaries

14.

HMG and HKG agree that when both husband and

wife apply and succeed under the General Allocation Scheme, the quota will be deducted from the occupational group of whoever is occupying a higher percentile

position. HMG and HKG will consider where deduction

should be made in cases where either husband or wife, or

both, fall into the Sensitive Services Scheme or

Disciplined Services Scheme.

It is agreed that a principal beneficiary marrying after becoming a British citizen under the

Package will not be able to transmit citizenship to his

or her spouse, if he or she ceases to be ordinarily resident in Hong Kong.

Adopted Children

16.

It is agreed that adopted children will be

treated in the same way as natural children.

Involvement of Employers in the Selection Process

17.

HMG agree that employers should not be involved

in the selection process in the General Allocation

Scheme.
