to regulate the flow of registrations under the Bill (thus catering for those who come at the top of the list towards the
run-up to 1997). Moreover, given the limited grounds for rejecting a recommended applicant, the onus will, by this provision, be placed on the Governor to recommend only those who
emerge as top candidates under the Scheme.
4.12 If, on a proper application of the criteria set out in the
scheme, two applicants fall to be recommended who are married to each other then, in order that one of the 50,000 places is not "wasted", the Governor should have power to decline to recommend one of the spouses.

4.13 The Secretary of State on receipt of a recommendation from the Governor should be placed under a duty to register the recommended HK BDTC unless the Secretary of State is satisfied that he is not of good character. The Secretary of State is to
have no power to register under the Bill without the Governor's
recommendation. The Bill should make it clear that no direct
approach to the Secretary of State for registration can be made
under the Bill. "Good character" is a requirement for naturalisation (see para. 1.1(b) of the Schedule to the BNA) and
that test is to be used as
criterion for refusal where recommendations are made to the Secretary of State under this
Bill.
