ENDORSEMENTS IN BOC PASSPORTS

Please refer to the correspondence on the above subject resting with your minute of 24 May to Ms Spencer.

We agree entirely with paragraph 4 of your minute under reference. Our legal adviser has however commented that after 1997 when BOC Passports will, of course, be issued by the then British Consulate General, we shall require the authority of the HK SAR Government to insert a "right of abode" endorsement in a BOC Passport, and this presupposes that we had already cleared the principle with the Chinese. I discussed this with Donald Tsang and he said that while we had agreed with the Chinese over BN (0) passports he did not recall that BOC s had been discussed at all. JD 164 is actually ambiguous on this point. The mechanics of this can obviously be worked out nearer the time, if and when we decide to offer this concession. But it might be worth raising this formally with the HKG to seek their views. Donald suggested we might consult Michael Suen in Constitutional Affairs. What do you think?
