Please refer to your letter of 13 December and FCO telno 65 to Gibraltar of 27 March. CATTACHED)

2. In your letter you explained that BDTC status is a composite citizenship and that a person could not seek to acquire something which he already had. In other words, BDTCs who held that status through a connection with Hong Kong could not seek to acquire BDTC status through a connection with Gibraltar. Your explanation was perfectly clear and as far as I was concerned that was that. The telegram under reference however has confused this issue again.

3. Paragraph 3 of the telegram (copy enclosed for ease of reference) seems to imply quite clearly that after a qualifying period of residence "Hong Kong people" may seek to acquire BDTC Gibraltar status. If by "Hong Kong people" is meant Hong Kong COI holders, or (after 30 June 1997) BN (0)s, then I would agree that they could become eligible to apply for BDTC status after a period of residence in Gibraltar. But if "Hong Kong people" is meant to include Hong Kong BDTCs then, provided the advice in your letter under reference is still valid, surely the implication in the telegram is incorrect.

4. I will not go into the point in TUR about residence in Gibraltar except to say that we do not need to legislate in order to grant residence to any qualified applicant; powers already exist.

5. Could you please clarify the nationality point?
