PROBLEM

To agree the Hong Kong Bill of Rights Bill 1990 for introduction into the Legislative Council.

RECOMMENDATION

It is recommended that the Hong Kong Bill of Rights Bill 1990 (BOR) at Annex A be introduced into the Legislative Council.

Members will be asked to advise whether this recommendation should be approved.

BACKGROUND AND ARGUMENT

Background

The Council considered a draft Hong Kong Bill of Rights Ordinance 1990 (the White Bill) on 9 January, 23 January and 6 March 1990. On 6 March 1990, the Council ADVISED and the Governor ORDERED, inter alia, that the draft Ordinance as amended by the Council, together with a commentary should be published as a consultation document, and following a two-month period of public consultation, a final draft Bill should be prepared for re-submission to Members, and subject to their approval, introduction into the Legislative Council. Copies of previous memoranda considered by Members, together with the records of the relevant meetings, are attached as Annex B.
