Our new draft differs only very slightly from yours. We prefer to talk of the rights "enjoyed" in Hong Kong rather than rights "set out" in the ICCPR since this reflects the wording of Article 39 of the Basic Law,

our "negative" clause would only affect future legislation. This is compatible with our proposal for a freeze and accommodates our proposal to delay the implementation of the article relating to privacy.

A delay in amending the Letters Patent until after the freeze period has ended, as suggested by you, is not considered politically desirable.
