(a) the fact that the purpose of this Ordinance is to implement further the International Covenant on Civil and Political Rights as applied to Hong Kong; and

(b) the origin of that Covenant and the need for uniformity in interpretation of rights recognised in that Covenant and similar rights recognised in other agreements having a similar origin."

It should be noted that such a clause would nevertheless still be likely to cause Chinese sensitivity as it would still be seen as "internationalising" Hong Kong.

During public consultation, a number representations asked for clearer definition of a state of public emergency and clarification of the circumstances and authority under which a state of public emergency may be proclaimed. The question arises as to whether it was appropriate to include a public emergency clause in the

Bill at all.

On reflection we propose that the clause should be retained for two reasons :
