Human Rights Commission

71.

A number of representatons have suggested that a Human Rights Commission should be set up following the enactment of the Bill of Rights. The LegCo Ad Hoc Group also recommends the establishment of a Human Rights Commission, because of the role such an institution could play in the education of the public about the rights guaranteed under the BOR and in fostering and monitoring the development of human rights in the territory.

The LegCo Ad Hoc Group has also suggested that the possible terms of reference of a Human Rights Commission for Hong Kong could include :

(a) an educational role;

(b)

a role of arbitrator/mediator in rights of action as between private individuals;

(c) review

of

legislation

and

recommendations for legislative changes;

making

(d)

investigation of complaints; and

(e)

preparation of guidelines human rights.
