eview of Existing Legislation

Thank you for your letter of 12 April 1990, in which you reiterated the LegCo Ad-Hoc Group's request for information on existing legislation which might be open to challenge on the grounds of inconsistency with the Bill of Rights. I fully accept your view that an accurate assessment of the likely impact of the Bill is difficult to make without such information, and we are, of course, keen to help as far as we can.

As I said in my memo of 31 March to the Secretary General, OMELCO, the review of existing legislation is still continuing, and we cannot yet provide very specific information. We have, however, prepared a summary of the possible areas of inconsistency so far identified, which we hope might be of use. This is attached.

I would stress that this summary represents the Administration's preliminary views, and is neither conclusive nor exhaustive. There is still a great deal of work to be done by the relevant policy branches, with the assistance of the Attorney General's Chambers, in reviewing areas thus identified with a view to ensuring that the implementation of existing policy objectives can be done in _a manner consistent with the Bill of Rights. Amendments to existing legislation will then be considered in the light of this review. It is in order to ensure that this work is

carried out thoroughly and comprehensively that we

we have proposed the two year freeze period.
