Persons not having the right of abode

12.

Article 9 does not confer a right of review in respect of a

decision to deport a person not having the right of abode in Hong

Kong or a right to be represented for this purpose before the

competent authority.

No obligation to legislate further

in respect of article 17

13. Article 17 does not require the enactment of further

legislation in respect of that article.

No right to elected Executive or

Legislative Council

14. Article 22 does not require the establishment of an elected

Executive or Legislative Council in Hong Kong.

Explanatory Memorandum

The purpose of this Bill is to implement further the

International Covenant on Civil and Political Rights ("ICCPR") as

applied to Hong Kong by

(a) making the rights recognized in the ICCPR part of the

domestic law, to be known as the Hong Kong Bill of Rights;

(b)

providing remedies in respect of a violation of any of

those rights.

Clause 2 is an interpretation provision. Amongst other

things, it provides that, in interpreting and applying the Ordinance,

regard shall be had to the fact that its purpose is to implement

further the ICCPR.
