CRIMINAL LAW (AMENDMENT) BILL 1990

(b) new section 23B(1) localizes section 1 of the Offences at Sea Act 1799 (1799 c. 34 U.K.), section 1 of the Admiralty Offences (Colonial) Act 1849 (1849 c. 96 U.K.) and part of section 686 of the Merchant Shipping Act 1894 (1894 c. 60 U.K.) by extending the criminal law to criminal acts taking place on board Hong Kong ships on the high seas. As a result criminal acts which are justiciable in Admiralty courts and are now triable in Hong Kong by virtue of a jurisdiction conferred by United Kingdom enact- ments will be triable by Hong Kong's courts because they will become offences under the law of Hong Kong itself;

(c) new section 23B(2) localizes the Territorial Waters Jurisdiction Act 1878 (1878 c. 73 U.K.) by applying the principle referred to in subparagraph (b) to certain acts committed in the waters of Hong Kong on board or by means of ships which are not Hong Kong ships;

(d) new section 23B(3) localizes part of section 686 of the Merchant Shipping Act 1894 (1894 c. 60 U.K.) by applying the principle referred to in subparagraph (b) to certain acts of British nationals on board Hong Kong ships in a port or harbour outside Hong Kong or on board certain non-Hong Kong ships;

(e) new section 23B(4) localizes section 687 of the Merchant Shipping Act 1894 (1894 c. 60 U.K.) relating to offences against person or property by seafarers employed on British ships in so far as it relates to Hong Kong ships and in so far as it is not localized by new section 23 B(1);

new section 23C requires the permission of the Governor to be obtained before proceedings for certain indictable offences are instituted; this derives from section 3 of the Territorial Waters Jurisdiction Act 1878 (1878 c. 73 U.K.).

Clause 3 amends the Offences against the Person Ordinance (Cap. 212) so as to provide that if a person dies in Hong Kong as a result of an act taking place on the high seas or elsewhere outside Hong Kong such act shall constitute murder or manslaughter or being accessory, whatever the nationality or citizenship of the person committing it, if the act would constitute murder or manslaughter or being accessory had it taken place in Hong Kong. This localizes section 3 of the Admiralty Offences (Colonial) Act 1849 (1849 c. 96 U.K.).

4. Clause 4 is a saving clause in respect of other criminal jurisdiction of the Hong Kong courts.

5. Clause 5 provides for the cesser of certain United Kingdom enactments in relation to acts covered by clause 2 or 3.

6. The Bill has no Public Service staffing or public expenditure implications.

本條例草案旨在修訂刑法,從而將本港法庭有關在海上或某些其他地方所犯的罪 行的審判權力本地化。

2. 草案第2條修訂《刑事罪行條例》(第200章)第III部,加入三條新條文(第23A至

23C條)。其內容分別如下—————

(a) 新的第23A條是釋義條文;

(b) 新的第23B(1)條將刑法伸展至發生於公海本港船隻上的刑事罪行,從而 將《1799年海上罪行法令》(英國法律1799年第34章)第1條、《1849 年海事罪行(殖民地)法令》(英國法律1849年第96章)第1條及《1894年 商船法令》(英國法律1894年第60章)第686條的部份規定本地化,因 此,可由海事法庭審理,而根據英國立法所授予審判權力,現可在香港 審理的刑事罪行,將可由本港法庭審理,因為這些行為將成為香港本身 的法律下的罪行;

(c) 新的第23B(2)(6)段所引用的原則應用於在本港水域的非本港船隻上 所犯或利用這些船隻所犯的某些罪行上,從而將《1878年領海審判權力 法令》(英國法律1878年第73章)本地化;

(d) 新的第23(3)條將(6)段所引用的原則應用於英國國民在香港以外的港口 或口岸內的本港船隻或在某些非本港船隻上所犯的某些罪行上,從而將

《1894年商船法令》(英國法律1894年第60章)第686條的部份規定本地 化;

(e) 新的第23B(4)條將《1894年商船法令》(英國法律1894年第60章)第687 搽,有關受聘用於英國船隻上的海員所犯的侵害人身或財物罪的規定本 地化。此祇關乎本港船隻,而且限於新的第23B(1)條未有本地化的地 方;

(S) 新的第23C條規定:在進行某些公訴罪起訴之前,必須獲得港督批准;

這項規定是出自《1878年領海審判權力法令》(英國法律1878年第73 章)第3條。

3. 草案第3條修訂《侵害人身罪條例》(第212章),規定:若有人因在公海或香港以 外其他地方所發生的行為而在香港死亡,而該行為如在香港發生的話將構成謀殺或誤 殺或從犯罪,則不論犯案人的國籍或公民身份何屬,該行為亦將構成謀殺或誤殺或從 犯罪。這項規定將《1849年海事罪行(殖民地)法令》(英國法律1849年第96章)第3條 本地化。

4. 草案第4條是有關本港法庭的其他刑事審判權力的保留條款。

5. 草案第5條規定,對於草案第2或第3條已管及的某些行為,若干英國立法應終止 適用。

6. 本條例草案對政府人手需求及開支方面均無影響。

THE EXEMPTIONS FROM IMMIGRATION RESTRICTIONS AND ALIEN REGISTRATION REQUIREMENTS CONFERRED ARTICLE 21(B) ARE IN PRACTICE COVERED BY THE UK IMMIGRATION (EXEMPTION FROM CONTROL) ORDER 1972 NO 1613 AS AMENDED. THERE ARE NO EXCHANGE CONTROL RESTRICTIONS NOR NATIONAL SERVICE OBLIGATIONS IN THE UNITED KINGDOM SO LEGISLATION HAS NOT BEEN NECESSARY. THE OBLIGATIONS CONTAINED IN ARTICLE 23(2) CAN BE GIVEN EFFECT ADMINISTRATIVELY, SO AGAIN LEGISLATION HAS NOT BEEN NECESSARY.

2. (PARAGRAPH 2(B) OF TUR) THE LIMITATIONS SET OUT IN SECTION 4(2) OF THE 1966 ACT ARE A REFLECTION OF OUR POLICY THAT PRIVILEGES GRANTED TO INTERNATIONAL ORGANISATIONS SHOULD BE NO GREATER THAN THOSE ENJOYED BY FOREIGN DIPLOMATIC MISSIONS. THE INTERNATIONAL ORGANISATIONS ACT 1968 (THUS ENACTED AFTER THE 1966 ACT) CODIFIES THE MAXIMUM PRIVILEGES WHICH MAY BE ACCORDED.
