jurisdiction the act shall be treated as having occurred in
Hong Kong.
(7) This section applies to
(a) a hovercraft if, and only for so long as, it is either above or on the surface of or in the water; and
(b) an act taking place on board a hovercraft if, and only if, when it takes place the hovercraft is either above or on the surface of or in the
water.
23C. Certain proceedings to be instituted
only with consent of Governor
(1) Proceedings to which this section applies shall be instituted only with the consent in writing of the Governor who shall give such consent only if, in his opinion, their institution is expedient.
(2) This section applies to any proceedings for an indictable offence, other than piracy, which is alleged to have been committed-
(a) within the waters of Hong Kong;
(b) by a person who is not a British national; and
(c) on board, or by means of, a ship which is not
a British ship.
(3) In this section "British ship" includes a Hong Kong ship.

Amendment of Offences against the Person Ordinance
The following section is added after section 8A of the Offences against the Person Ordinance (Cap. 212)--
"8B. Certain homicides to constitute offences
(1) Where—
(a) an act takes place on the high seas or in any other place
outside Hong Kong:
(b) the person against or in relation to whom the act is committed or took place dies in Hong Kong as a result of the act; and
(c) the act would, if taking place in Hong Kong, constitute murder or manslaughter or being accessory to murder or manslaughter,
