As you will know, the nationality package is being dealt with on a very restricted basis. I myself have not seen the full picture but I appreciate the need for caution.

There is one point, however, on which I would be grateful if you could keep an eye. As I understand it the present intention to be reflected in Clause 2(2) of the Bill is that those who benefit from the package will lose their BDTC status before 30 June 1997. This is important since should they retain such a status the Chinese would be able to argue that we were in breach of JD 226 thus challenging our assertion that nothing in the nationality package breaks our JD commitments.

I have, however, recently been informed that there may be some doubt in the Home Office about returning the provision concerning the automatic loss of BDTC status. Without understanding the basis of any Home Office concern, I cannot comment authoritatively but it would be a cause for concern if we gave the Chinese a basis for arguing we had breached the JD. I am sure you are well up to speed on this, but would be grateful if you could keep an especially careful eye on it.
