The main purpose of this Bill is to give effect to Hong Kong's international obligations under the 1985 Vienna Convention for the Protection of the Ozone Layer and the 1987 Montreal Protocol on Substances that Deplete the Ozone Layer. The Bill prohibits the manufacture of and controls the import and export of substances (scheduled substances) that deplete the ozone layer. Control of import and export is achieved through registration and licencing provisions (clauses 5 to 8).

2. The Bill also enables the Governor in Council to make regulations for the control of products containing or made with a scheduled substance, for the use of a scheduled substance in a prescribed plant or process and for the use, recovery recycling or disposal of scheduled substances (clause 16).

3. Enforcement of the Bill is by public officers authorized by the Director and, in relation to imports and exports, by the Customs and Excise Service under the Import and Export Ordinance (Cap. 60) which is amended by clause 18 to reflect the fact that licences are issued under this Bill. Clause 19 amends the Second Schedule to the Customs and Excise Service Ordinance (Cap. 342) to include a reference to this Bill so that the arrest powers in sections 17 and 17A of that Ordinance are also applicable when exercised by the Customs and Excise Service.

4. A total of 11 additional posts will be required in the Environmental Protection and Trade Departments at an estimated annual staff cost of $2.6 million. Revenue from registration and licence fees is expected initially to be about $390,000 but will decline as the quota for exports and imports is gradually tightened as required under the Montreal

Protocol.

3. 條例草案由環境保護署署長授權的公職人員負責執行,而在進出口方面 執行工作則由海關根據《進出口條例》(第60章)進行。條例草案第18條修訂《進 出口條例 》,以反映有關許可證是根據本條例草案發出的。第19條修訂海關條例 (第342章)附表2,使該附表亦提述本條例,以便該條例第17及17A條所指的拘捕權 由海關行使時,亦可適用於本條例草案。

4. 爲配合本條例的施行,環境保護署及貿易署將需要開設共11個新職位,每年 的開支估計為$2,600,000。註冊及牌照收費預料在初期每年會帶來$390,000的收入, 但隨着進出口配額遵照《蒙特利爾議定書》的規定而逐步收緊,收入將會減少。
