THE PROBLEM
On 10 October 1989, after considering memorandum XCC (89) 136, Members ADVISED and the Governor ORDERED, inter alia, that in the first instance а Provisional Airport Authority (PAA) should be set up to prepare for the development of the replacement airport and that subsequent ly an Airport Authority` (AA) should be established to carry forward the planning, funding, development, and management the airport.

To implement the first part of the above decision and to provide the PAA with the necessary power to enter into contracts engage staff, and acquire assets and accept liabilities in its own right, a statutory framework is necessary. To meet this requirement the Provisional

It is recommended that the Provisional Airport Authority Bill 1990, annexed, should be introduced into the Legislative Council.

BACKGROUND AND ARGUMENT

In deciding to establish initially a PAA it was recognised that the legislation for the AA would take some time to prepare in view of the many complex issues involved. The se not only include the structure, composition, functions and responsibilities of the AA, but also the
also the issue of the future relationship between the AA and Government at the airport where many services. (such as customs, immigration, air traffic control, police and fire services) would remain Government responsibilities. Against this background, and with a view to establishing an appropriate body as soon as possible to spearhead the preparatory work for the new airport, it was decided
