Hong Kong is party to the International Convention in Endangered Species of Wild Fauna

CITES requires that there should be no trade in highly endangered species. The Animals and Plants (Protection of Endangered Species) Ordinance (which gives legal backing to CITES) does not explicitly provide powers to prevent such trade. The Ordinance needs to be changed to provide these powers.

RECOMMENDATION AND ADVICE SOUGHT

We recommend that the Animals and Plants (Protection of Endangered Species) (Amendment) Bill, at Annex A, should be introduced into the Legislative Council.

Members will be asked to advise whether this

recommendation should be approved.

BACKGROUND AND ARGUMENT

UK is a party to CITES and it applies to Hong Kong. The Ordinance together with its Schedules were in 1976 to give effect to CITES.

Species of wild fauna and flora in which international trade requires particular control are listed by CITES as follows :-

(a)

Appendix I species which are highly endangered and threatened with extinction. Commercial trade (i.e. import and export) of Appendix I species should be prohibited.

(b)

Appendix ΙΙ

species which although not

necessarily threatened now with extinction, become so unless trade is controlled; and
