(TAIWAN) ORDER 1985: EXTENSION TO HONG KONG
I refer to the draft Order sent with FCO's letter to you of 9 January.

There are some problems with it. The Taiwan Order 1985 is no longer part of the law of the UK by reason of its revocation under Article 8 (Schedule 5) of the Application (No. 2) Order 1989 and cannot now be extended. The question as to whether the Taiwan (Extension to Territories) Order 1987 (S.I.1826) is a proper vehicle for the extension was considered here earlier - I attach copies of the exchange of minutes between Mark Bucknill and myself in June last year. There appears to be no correspondence with IPCD on the issue. It would be most convenient if S.I.1826 could be used, but in the view of the doubts raised we need to obtain the views of FCO legal advisers. I am quite happy for you to copy the attached minutes to Mr Ward.
