This makes it a unique concept.
The
Basic Law has been enacted under China's
legal system which, in so far as it is
influenced by Western legal thought, has
been influenced by the civil law system.
But it is to be applied to Hong Kong which
is and will continue to be a common law
jurisdication and whose current laws will
remain in force. We are working together
with the Chinese to ensure that our
solutions to the legal and practical issues
thrown up by the interplay between the two
systems are as imaginative and innovative as
the original principle of "one country, two
systems".
8. One point which has exercised legal
minds considerably is the exact relationship
between the Basic Law and the Chinese
Constitution.
The Basic Law is enacted
under Article 31 of the Chinese Consitution
which states "The state may establish
special administrative regions where
necessary. The systems to be instituted in
Special Administrative Regions shall be
