IRO SUB-GROUP : MULTILATERAL TREATIES

1. I refer to Hong Kong Telno 543 which has the above heading, but which was followed by two draft papers dealing with customs treaties.
2. Hong Kong have deliberately prepared the two draft papers as models for the future. My own view is that the formula which Hong Kong have proposed is a sensible one, for the reasons which Hong Kong give in paragraph 2 of TUR. can only hope that the Chinese are likewise content.

3. I think that we need to consider ourselves what procedure we should adopt in the future for clearing draft papers on multilateral treaties to be considered in the IRO Sub-Group. I suggest that we need to do two things; first, we should consult the relevant Home Government Department
(if any) on the treaty concerned (and I note that you have written to Customs and Excise on the two draft papers proposed by Hong Kong, as we agreed in our telephone conversation); second, copies of the papers should be sent to NTD so that they can check the accuracy of the various technical details, and NTD's reply should be routed back to HKD through Legal Advisers so that we can check the drafts from our point of view, with the benefit of the assistance of NTD (one piece of information which NTD might usefully provide is the Treaty Series reference for the agreements concerned, so that they can more easily located in the Legal Library).
