ADHESION TO INTERNATIONAL AGREEMENTS

I send herewith a circular minute from FCO/HKD in case you have not been sent a copy. The re-negotiation of bilaterals is, of course, being done under special arrangements. Otherwise there are two possible areas of interest so far as ICAO is concerned.

The first is the adoption of amendments to Annexes, which does, I suppose, constitute "an amendment or modification [s] to existing rights and obligations" Insofar as China is a member of the Council which adopts such amendments I imagine it could be argued that no further consultation is necessary. I suppose that the situation might be different if China were to specifically oppose a particular amendment during its formal adoption by the Council and were subsequently to reject implementation. This has not happened during the past seven years or so and seems unlikely to occur in the future.

The second area related to amendments to the Chicago Convention itself, either by amendment e.g. Article 50 (a) or Protocol e.g. terrorism at airports. In addition we have the hoped - for new Explosives Convention. The applicability of the agreed policy in these cases seems to me much more direct. If you have not already done so, it might be worth considering whether we should tell FCO how we are interpreting the situation.
