OPEN SKIES: AREA OF APPLICATION
1. I have seen the reply from the Governor in Hong Kong (Hong Kong telno 684) to FCO telno 415 about the territorial application of an Open Skies treaty.
2. I accept that we should seek to exclude Hong Kong from the scope of this treaty, and will be including a recommendation to this effect in the submission we will shortly be putting up on the subject.
3. I would be reluctant, however, to use as justification for such exclusion simply the argument in para 3 (d) of FCO telno 415 that "there are no advantages in including Hong Kong, since the territory lies outside the focal area of the agreement". The argument alas has little validity. The focal area of the Open Skies treaty will be, if Western proposals are followed, the territory of the participants in North America, Europe and Asia. Hong Kong falls into this category; and, at any rate as far as the Soviet Union is concerned, it is of potential interest because there are British military facilities there.
4. By contrast, the arguments in A-C of para 3 of FCO tel under reference are more compelling (and more likely to persuade the Soviet Union).
