1. I am sorry to bother you all again over this subject, but we have now been asked by our Delegation to the Budapest Open Skies Conference to produce a consolidated list of territories to be covered by the prospective regime. We intend to reply

in the draft telegram, offering a list for informal use, but sticking to a general formula on territory for the treaty text itself.

2. The original Legal Advisers' formula (on which your departments were consulted Chris Hughes minute of 16 March, copy attached for ease of reference) needs to be amended to take account of the fact that the Falkland Islands and Hong Kong will definitely not be included. I should be grateful to know, by cop today please, if you are content with the wording we now propose. In particular, is it correct to refer to the territories we intend to include collectively as "dependent territories"? If not we shall revert to the Legal Advisers' formula of "territories for the international relations of which UK is responsible".
