ARTICLE 12
REPLACEMENT LAUNCH
The Client is entitled to request a Replacement Launch from CGWIC in the event that, following the Launch, the Launch Mission or Payload Mission has not been
accomplished for any reason whatsoever, provided the Client presents its request for the Replacement Launch within six months after the Launch. However, this Article shall not apply if CGWIC is obliged to provide a Reflight for the Launch in accordance with Article 11 of this Contract.
The Client shall present to CGWIC a written Replacement Launch request proposing its desired Launch Period and Payload Mission, which shall then be mutually agreed by the Parties.
Remuneration for CGWIC's Services for the Replacement Launch shall be a price favorable to the Client mutually agreed by the Parties.
The payment schedule under the contract for the Replacement Launch shall provide that the entire price for CGWIC's Services for the Replacement Launch shall be paid to CGWIC before the said Replacement Launch and upon substantially the same terms and conditions as provided in this Contract.
The contract for the Replacement Launch shall be substantially upon the terms and conditions of this Contract amended as appropriate to reflect the experience of the Client and CGWIC.
