relation to the causes and origins of the incidents that may have occurred during the Launch Vehicle Flight and that, in the opinion of the Client, have caused the degradation of the operational capacity or nominal lifetime of the Payload. If the Client has elected the Reflight option, such notice shall also include a request for a Reflight. CGWIC shall be released from any obligation under this Article unless such notice is received by CGWIC within 180 days of the date of the Launch.
Each Party undertakes to provide the other with all information as well as all technical assistance required to assess whether a Launch Failure has occurred as well as the effects of the alleged Launch Vehicle malfunction on the operational capacity or nominal lifetime of the Payload. CGWIC shall forthwith upon it becoming aware of a Launch Failure or the possibility thereof or the destruction of the Launch Vehicle advise the Client in writing of the circumstances giving rise to the Launch Failure or the possibility thereof and such details in relation to the causes and origins thereof.
CGWIC will provide the same Services for the free
The Reflight as were provided for the initial Launch. Payload for the Reflight shall be substantially similar as to its physical dimensions and mass to the Payload it replaces and as similar as practicable with respect to its interface with the Launch Vehicle as the Payload it replaces. CGWIC acknowledges that the Client may not be able or may not wish to obtain an identical Payload as the initial Payload. If the Payload for the Reflight requires a different interface, such as an HS376 or RCA3000 satellite, then the Client shall pay CGWIC for the cost of such interface. If the Client acquires a satellite that requires a launch vehicle other than the Long March 3, then CGWIC will credit the Client for the price of the initial Launch against the price of a Launch using such other launch vehicle and the Client shall pay the difference. CGWIC shall propose a Launch Period to the Client within 30 days from the receipt of the notice given in accordance with Paragraph 11. 4 above. The proposed Launch Period for Reflight shall take into account the ability of the Client to obtain a replacement Payload on terms and conditions satisfactory to the Client and the time within which such Payload will be available as well as the other requirements and needs of the Client and CGWIC's scheduled commitments with CGWIC's Clients provided however that such Launch Period shall not be earlier than 18 months after the Client has provided technical information of the Payload
