consider that any such legal or arbitration
proceedings are about to commence.
Provided always that the granting of this Licence shall
in no way be construed as a waiver by the Governor of any
failure on the part of the Licensee to comply with any
condition hereunder prior to the date of grant.
10.
Waivers
No failure or delay by the Governor in exercising any
right, power or remedy under this Licence or the Act
shall operate as a waiver thereof, nor shall any single
or partial exercise of any right or remedy preclude any
other or further exercise thereof or the exercise of any
other right or remedy. The rights, powers and remedies
herein provided are cumulative and are not exclusive of
any rights, powers or remedies provided by law.
11.
Applicable law
The construction validity and performance of this Licence
shall be governed in all respects by the law of Hong
Kong.
