On 15 May 1990, when Members considered the proposal to make pension increases a statutory right, we were directed to consult the Chinese at a time when there was a reasonable chance that they would respond favourably. We did not consult the Chinese when the pensions proposals were approved by the Council because the prevailing atmosphere then was not considered conducive to amicable discussion.
Since then, while the working relation between the two sides has not improved significantly, the general atmosphere has been better. In view of the considerable Chinese interest in civil service pension issues, and their wish for an early briefing, any further delay in approaching them may work to our disadvantage. We therefore propose to brief the Chinese as soon as possible, say in
November 1990. To facilitate discussion, it is recommended that information papers should be passed to the Chinese in the first
instance on
(a)
the existing provisions;
(b)
the proposed modifications to the existing arrangements; and
(c)
the staff suggestions for improved pension safeguards.

In explaining the modifications which we intend to introduce (paragraphs 8 (c) to 8 (g)), we would invite the Chinese to state any views
views they may have, and assure them that these would be considered seriously. We would retain the right to take final decisions but would wish, if possible, to go ahead in agreement with the Chinese.
