Terms and Conditions of the

New Pension Scheme (NPS)

The NPS came into effect in 1987. Those joining the civil service after that date are subject to the pensionable terms of the NPS. Those civil servants recruited before that date are subject to the terms of the Old Pension Scheme (CPS) unless they elect to switch to the NPS. They have been given until 1992 to exercise this option (unless over 50 years of age). I would like to transfer to the NPS but am concerned by the lack of information on the possible consequences of changing to the NPS.

I would be very grateful if written and legally binding answers could be given to the following questions:-

(a) as Her Majesty's Government (HIC) involved in the drafting of the OPS and has HG formally approved the OFS?

(b) Similarly, was IMG responsible for the

drafting of the NFS in any way and has HIG formally approved the NPS?

(c) In the event of problems with Hong Kong

civil service pensions in the future, will HIIG treat those officers who have transferred to the NPS any differently or less favourably than those officers who stay on the OPS? Can a written guarantee to this effect be obtained from HMG?

(a) I transferred from agreement to pensionable

terms in 1985. I elected to buy back my pensionable service to 22nd March, 1978, the date of my first appointment. I did so on condition that I would not be differently regarded or less favourably treated by both
