Thank you for your letter of 30 April enclosing one from your constituent, Mr M H Tallboys of 10 Walnut Close, Stretton, about pensions of Hong Kong Civil Servants.

The Joint Declaration and the Basic Law for the Hong Kong Special Administrative Region. both make express provision for the continued employment of civil servants after 1997 and for the payment of pensions for those who retire. They state that public servants previously serving in Hong Kong may all remain in employment and continue their service with pay, allowances, benefits and conditions of service no less favourable than before, and that the Hong Kong Special Administrative Region will similarly pay pensions irrespective of the nationality or place of residence of the persons concerned.

Your constituent's questions about whether the British people will need to meet pensions as regards Hong Kong Civil Servants who take advantage of the schemes (ie the nationality package) and come to Britain does not therefore arise. If any such Hong Kong Civil Servants chose to leave Hong Kong and come to the United Kingdom, that will be a matter for them: the United Kingdom Government is under no liability to provide for their pensions, to provide any redundancy payments for those of them who leave or to find thea jobs as British Civil Servants.
