HONG KONG: HIGH COURT JUDGES: PAYMENT OF PENSION POST 1997

I should be grateful for your views on what advice we should give to Mr Godfrey, a High Court Judge, regarding HMG's liability to

1.

pick up judicial pensions post 1997 if the SARG fails to pay - see A. If Mr Godfrey did transfer to P and P he would be eligible to join HMOCS.

2.

In response to a previous enquiry from a police officer, we offer the advice at B. I am not inclined to go further than before. To add a sentence "HMG has long recognised its obligations towards HMOCS members and I am sure the Government of the day would take appropriate action if the situation warrented it" would be very divisive if it goes out drawing clearly, as it does, a distinction

between HMOCS and the rest.
