Transfer to

Permanent and Pensionable Fstablishment

I apologise for the delay in replying to your memo

of 3 July 1985.

I confirm that Police Officers who convert from agreement to pensionable terms after the initialling of the Sino-British Agreement on the future of Hong Kong on 26 September 1984 do so on the same terms and conditions as their colleagues who converted prior to the initialling of the Agreement. A statement to this effect was conveyed to the Chairman of the Police Force Council in response to an enquiry made by the Staff Side of the Council. I have referred your request for a similar assurance from Her Majesty's Government to the Foreign and Commonwealth Office for consideration.

With regard to the effective date of transfer,

I would like to stress that while an officer will not be accepted onto the permanent and pensionable establishment earlier than the date he passes his medical examination, he may elect to convert his previous service as pensionable service by refunding the contract gratuities which he had received in respect of that period of service. It would therefore be possible for him to bach-date his passionable servies to the date of his appointment on agreement terms and en his retirement to have his pensions computed on the basis of the augmented pensionable service,
