I refer to FCO telnos. 2040 of 10 October 1989 and 227 of 24 January 1990.

Prior to 1973, overseas Police officers were recruited through the Crown Agents on pensionable terms of Her Majesty's Overseas Civil Service. When agreement terms of service was introduced in 1973, we informed the Crown Agents vide our letter Ref. PR 2/4341/72 of 7 March 1973 that successful candidates would have the choice of pensionable or contract terms of service. If they joined on contract terms, they would be allowed to transfer to the permanent and pensionable establishment on completion of their first contract or at any stage during their subsequent contracts. They were not eligible for enrolment as members of HMOCS unless they had transferred to the permanent and pensionable establishment.

The Crown Agents noted this arrangement vide their letter M5/M3B/711022 of 28 March 1973. Copies of the letters are attached.

In connection with the Hong Kong Government Office in London taking over the recruitment of professional and technical overseas officers from the Crown Agents, Mr Champion of your office confirmed in his letter of 23 July 1974 that there would be no problem for police officers recruited by the London Office qualifying for membership of HMOCS. In the Commissioner, London Office's letter of 8 August 1974 and our letter of 12 March 1975 to FCO, it was affirmed that we would continue with the prevailing arrangements for police recruitment and adopt the procedures suggested in paragraph 9

Mr Champion's letter for other vacancies handled by the London Office. That is to say, police officers recruited on contract terms would be allowed to transfer to the permanent and pensionable establishment and their applications for HMOCS membership would be forwarded to FCO. For professional and technical officers recruited on contract terms, recommendations for transfer to permanent terms and for admission to HMOCS would be submitted to FCO for approval.

As you are aware, this arrangement has changed to the extent that only those overseas officers who were appointed on or before 28 March 1985 may apply for transfer to the permanent establishment before the expiry date of their current agreement or 31 March 1990, whichever is the earlier.
