Public Interest immunity did not form any of the grounds for
the refusal. A date will now have to be set for the substantive hearing on the application for habeas corpus.
The Secretary of State may consider the surrender of
Mr Osman to Hong Kong only after all the court proceedings in this country are concluded. Any question of
discontinuing Mr Osman's prosecution would be a matter for
the Hong Kong authorities.
6. Mr Osman has made 3 applications for bail. The first
was refused on 26 June 1986, the second on 26 July 1989 and
the third on 4 October 1989. Mr Osman has also made 2
applications to the European Commission of Human Rights.
The first was declared inadmissible on 13 March 1989.
second, made in December 1989, is still under consideration
by the Commission.
