I write further to your telegram 921 of 4 May 1990

in respect of the above.

Whilst this is hopefully now a matter of academic interest, I thought you might wish to know that our legal advisers have advised that although we are obliged to permit innocent passage through Hong Kong waters, passage is only innocent so long as it is not prejudicial to the peace, good order or security of Hong Kong. It is their view that permitting the vessel to enter Hong Kong waters while on passage from Singapore to Taiwan might well have been prejudicial to the peace, good order and security of Hong Kong.

It would be helpful for future reference to have

your legal advisers views on this issue.
