NOTIFICIATION OF LOSS AND DAMAGE SUFFERED BY UK NATIONALS

AND COMPANIES IN KUWAIT AND IRAQ

Nationality, Treaty and Claims Department have invited UK companies and nationals whose property in Kuwait or Iraq has been lost, damaged or destroyed, or they have suffered personal injury as a result of Iraq's invasion of Kuwait to notify the Department of details with a view to opening a list. The existence of the list is being publicised by means of press advertisements. It is emphasised that the opening of the list does not constitute the submission of a claim nor does it recognise the existence of any right to claim compensation from any source. I attach copies of the various notices and claim form. The Claims Department tell me that this action has been taken entirely on their own initiative, the purpose being to gather evidence at an early stage to support subsequent claims. Previous experience has shown that with the passage of time, there is frequently a lack of such evidence necessary to support later claims.

2. Hong Kong have asked for guidance on how companies can register their claims and what action the Hong Kong Government should take. Copies of the notice and claim form were faxed to Hong Kong, who have now posed the following questions:-

(i) The definition of a UK company within the context of this exercise, and as the forms apply only to UK
