FCO TELNO 2963: AIR EMBARGO OVERFLIGHTS

The TUR referred to arrangements for delegation of the

Secretary of State's powers under the Iraq and Kuwait (United

Nations) (Dependent Territories) (No 2) Order 1990 (SI 1990 No

: 1988).

The Secretary of

State for Transport, under article 7

paragraph (1) of the Order, hereby delegates to the Governor of

Hong Kong until further notice his powers in relation to Hong

Kong under article 2. The Secretary of State further authorises

the Governor to delegate these powers to any person approved by

the Governor, and that person shall be deemed to have been

approved by the Secretary of State for the purposes of article

7 paragraph (1). The powers delegated shall be exercised in

conformity with United Nations Security Council Resolution 670.

The Secretary of State will expect the Hong Kong Authorities

to follow similar principles to those being applied in the United

+ Kingdom as set out in the attached paper. In particular an

aircraft bound for Iraq or Kuwait should be required to land for

inspection if the Hong Kong authorities are not satisfied that
