We are writing to you in our capacity of Chairman and Deputy Chairman of the Kuwait Investment Office. This letter follows Iraq's illegal invasion of Kuwait and the subsequent purported annexation of our country which has been declared void by the United Nations.

On 6th August the United Nations called on all States to take appropriate measures to protect the assets of the legitimate Government of Kuwait and its agencies and not to recognise any regime set up by the occupying power.

We have been advised by Leading Counsel in England that, it being the case that the United Kingdom Government continues to deal with the Amir and his Cabinet as the legitimate Government of Kuwait, they or their authorised agents will in the opinion of Counsel be entitled under English law to deal with all the assets of the State of Kuwait in the same manner We expect that the legal position is no as they have done prior to the invasion by Iraq. different in other countries where the State of Kuwait owns assets, and which continue to recognise the Government of Kuwait.

Accordingly only the legitimate Government of Kuwait and its duly authorised agents have authority to deal with the assets of the State of Kuwait, and all assets of the State under the control of the Kuwait Investment Authority and/or the Kuwait Investment Office remain under their control.

We enclose a copy of a Letter of Authority from Sheikh Ali-Khalifa Al-Sabah with the notarised Affidavit of Mr. J.W. Jeffrey. Sheikh Ali-Khalifa is the Minister of Finance and responsible for all the financial affairs of the State of Kuwait. He is also the Chairman of the
