3. The UN Act 1946 is an FCO responsibility.

This does

not however of itself pre-judge which Minister will have Departmental responsibility for operating restrictions made under it. In the present case, as agreed with the DTI, the licensing régime will be operated by the Trade and Industry Secretary conjointly with the exercise of his licensing powers under the DTI legislation. In the Dependent Territories, the licensing authority will be the Governors, who will be receiving guidance coordinated with the DTI.

In substance, therefore, we have already taken on board. the points made by Mr Sainsbury to Mr Hurd this morning. DTI officials have been operating closely with us throughout in the preparation of today's Orders and we will remain in close touch with them and other Departments over the many tricky questions of interpretation and

implementation of the Security Council resolution that are

bound to arise over the next few days.
