PROSECUTION OF MEMBERS OF THE UNITED DEMOCRATS OF HONG KONG

There are three separate court cases involving a total of
seven people regarding protest action taken during January
and February 1990. The seven involved are all liberals in
Hong Kong.
- All the cases involve prosecution action for unauthorised use of loudhailers and the unauthorised collection of money.
- All of the defendants were warned repeatedly by the police
that their actions constituted offences before any action to
prosecute was taken.
- There is little doubt that those involved wished to
embarrass both HMG and HKG. But it is important to uphold
the independence of the prosecuting authorities and to show that no section of the community or political spectrum is
above the law.
Legal advice is that the relevant provisions are not in
principle in conflict with the Bill of Rights but HKG will examine all laws to ensure that they are fully compatible
with the Bill of Rights.
