Section 3(1) of the Audit Ordinance states that "The Governor, with the prior

approval of the Secretary of State, shall appoint a person to be the Director of Audit".

III. Authority

The Secretary of State was stipulated as the authority over certain provisions in the Pensions Ordinance, Cap. 89, prior to the 1987 amendment. After the amendment, while reference to S of S was removed from the legislation, S of S has asked to retain his authority in practice for cases where the approving authority in the legislation has been changed from S of S to the Governor.

In the case of an officer selected for appointment by the Secretary of State, the final decision relating to retirement on medical grounds shall rest with the Secretary of State.

The authorisation of the Secretary of State is required in cases where an officer needs to be medically examined whether he should be invalided, and he in the U.K.
